THE JAZZ CORPORATION: TERMS AND CONDITIONS TJC 5TH EDITION (TO BE READ IN CONJUNCTION WITH THE BOOKING FORM TJC 5TH EDITION)
1. DEPOSIT: The contract is effective from the date of receipt of the duly completed and signed booking form together with the agreed deposit. If payment of the deposit is by cheque, sufficient time must be allowed for clearance before the function date. Cheques should be made payable to P. KENNY. Please do not send cash through the post.
2. BALANCE FEE: Unless varied by agreement in writing, it is a condition of the contract that the balance fee is payable either (I) in advance of the function date in cleared funds or (II) in cash at the function; please note further that this is payable during an interval at the function and not at the end to avoid unnecessary delay after the agreed completion time. Delays in payment will result in an extra attendance charge in respect of each member of the band.
3. ELECTRICITY: (a) The Hirer undertakes to ensure an adequate and safe supply of electricity to the performing area, and in particular at least one power point (of the square pin variety) supplying 240V AC with a minimum of 13A. The band can supply at the Hirer's prior request an extension cable of 40 metres length but for safety reasons this will not be available where the cable traverses an area which is accessible to persons other than the band members. (b) Where a generator is used, there must be sufficient supply to guarantee a constant 240V current with a constant minimum of 13A; otherwise the band reserves the right to refuse to perform without prejudice to the payment of the fee.
4. SIZE OF PERFORMING AREA: The Hirer undertakes to provide a Performing Area not smaller than the Minimum Space Requirement.
5. CANCELLATION: (a) It is agreed that cancellation is effective on the date of receipt of the Hirer's written notification. (b) Cancellation before the date which is six calendar months before the date of the function will result in one half of the total fee becoming immediately due and payable (deducting any deposit already paid). (c) Cancellation on any date from the date which is six calendar months before the date of the function to the date which is three calendar months before the date of the function will result in three quarters of the total fee becoming immediately due and payable (deducting any deposit already paid). (d) Cancellation on any date which is after three calendar months before the date of the function will result in the full fee becoming immediately due and payable (deducting any deposit already paid).
6. ACCESS TO THE VENUE: (a) The fee agreed is on the assumption that the band will be given access to the performing area from one hour prior to the commencement of the performance (for setting up), and that the equipment of the band can be taken down and removed immediately on completion of the performance. If the Hirer requires any or all musicians to be involved in further attendance time it will be necessary to agree a charge for such extra time before the contract is entered into. Please note that our insurers will not cover equipment left unattended by the band members at a venue. (b) For the purpose of unloading equipment the Hirer agrees to provide or arrange to provide vehicular access as close as possible to the Performing Area.
7. INTERVALS: The band will require intervals during the performance, timings to be agreed with the Hirer.
8. ACCESS TO THE PERFORMING AREA: It is the responsibility of the Hirer to ensure that persons other than the band members do not encroach upon the band's Performing Area and do not handle or use any of the band's equipment; any damage thus caused will be the liability of the Hirer.
9. WHERE the conditions at the venue represent a danger to the musicians or the public the band reserves the right to refuse to perform without prejudice to the fee payable.
10. ADDITIONAL PERFORMANCE TIME may be possible upon request of the Hirer and at the discretion of the band leader and upon payment of an agreed additional fee.
11. OUTDOOR FUNCTIONS: The Hirer undertakes to provide shelter for the protection of the musicians and their equipment from sun, precipitation and blustery conditions.
12. PRIOR SURVEY OF VENUE: Prior inspection of the venue is available if required for which an additional fee would be payable.
13. REFRESHMENTS: In the case of engagements of substantial length or distance travelled (or both) it would be appreciated if provision would be made for food and drink to be available to the band members during an interval in the performance.
14. REQUESTS: The band will be happy to perform any requested tunes where these fall within its rehearsed repertoire; requests for other pieces will require additional work before the function and an additional charge would become payable
15. VENUE LOCATION: The Hirer undertakes to supply sufficient and clear details as to the location of the venue and if necessary a location map. Such details or plan would need to be received at least a week before the event.
16. BANDROOM: For the purposes of safety and to reduce unsightly clutter it would assist if a cleared space could be provided for storage of the band's cases, preferably as close to the Performing Area as possible.
17. IF THE HIRER is intending to employ the services of a disco or other band in conjunction with the Jazz Corporation it is vital that his should be made known to the Jazz Corporation before the contract is entered into.
18. THE TERMS OF THE AGREEMENT may only be varied by mutual consent and in writing.
